近年来,PUA亲密关系中不法行为人利用精神控制致被害人自杀死亡的案例频发,危害严重。但我国现行法律对亲密关系中精神控制行为致人自杀死亡的行为与结果之间的因果关系界定模糊,导致受害人的合法权利难以得到有效保护。PUA教程中"教唆自杀"的概念需要进行明确界定。根据我国涉精神控制犯罪的司法现状,结合国外"客观归责理论",可以证成精神控制行为与自杀死亡结果之间的因果关系。同时,参考英美法系国家的相关立法和案例,应当适当扩张教唆的内涵,将教唆自杀单列成罪。这样才能更好地实现规制PUA中"教唆自杀"行为的目的。
Abstract：In recent years, there are frequent suicide cases caused by illegal actors using mental control in PUA intimate relationship, and the harm is serious. However, current law in China has a vague definition of the causal relationship between mental control and suicide in intimate relations, which makes it difficult for the legitimate rights of victims to be effectively protected. The concept of abetting suicide in PUA course needs to be clearly defined. According to the current judicial situation of mental control crimes in China, combined with the foreign objective imputation theory, the causal relationship between mental control behavior and the result of suicide death can be proved. At the same time, referring to the relevant legislation and cases of common law countries, the connotation of instigation should be appropriately expanded and abetting suicide should be listed as a separate crime to achieve the purpose of regulating the suicide encouragement behavior in PUA.
